Bombay HC: Homebuyers Can Demand Refund Without Waiting for OC

The Bombay High Court has ruled that a homebuyer who chooses to walk out of a delayed real estate project has an “absolute and unqualified” right to a refund. The court made it clear that this refund cannot be made to wait for the developer to obtain an occupation certificate (OC).
Refund not linked to OC
Developers often argue that a refund claim can only be raised after the project receives an OC, especially when possession is yet to be granted. The High Court rejected this view, stating that the buyer’s right to withdraw from an ongoing delayed project is independent of the OC timeline.
For homebuyers in Maharashtra, this means they do not have to keep waiting indefinitely for a project to be completed. If the developer has missed the agreed possession deadline, the buyer can demand the money back along with interest.
