A residential apartment in Maharashtra cannot automatically be rented out as a bed-and-breakfast or service apartment. The planning law for the area fixes the permitted use of the land and building, and most housing societies are approved only for residential use. Short-term paid stays with services can be treated as a commercial hospitality activity, not ordinary residential letting.

Society bye-laws and NOC

The documents that bind a flat within its housing society, including bye-laws, conveyance or deemed conveyance records and society resolutions, usually decide whether owners can run a business or paying-guest style operation. Many societies prohibit commercial use, restrict entry to unknown guests, or require a no-objection certificate. Without society consent, a B&B or service apartment listing can trigger notices and disputes.

Approvals and compliance

If the use is allowed, operators may still need municipal trade or health licences, fire safety clearance, GST registration where applicable, and compliance with local lodging and police verification rules. Parking, waste, noise and security norms also apply. Mumbai, Pune, Thane and other Maharashtra cities may have different development control rules, so verify with the local planning authority.

What buyers and investors should check

Before buying a flat for rental yield or hospitality use, check the occupancy certificate, approved plans, permitted use, society bye-laws and past resolutions. Confirm whether short-term stays are permitted and what NOCs are needed. Unauthorised commercial use can lead to penalties, sealing or forced closure, reducing the property's resale and rental value.
