CBDT Grants Income Tax Exemption to Odisha Real Estate Regulatory Authority
The Ministry of Finance, under the Central Board of Direct Taxes (CBDT), recently issued a notification on November 26, 2025, regarding income tax exemption. This notification is particularly significant for the Odisha Real Estate Regulatory Authority (ORERA).
In powers given by section 10 (b) of clause (46A) of the Income Tax Act, 1961, the Central Government has notified the “Odisha Real Estate Regulatory Authority” for income tax exemption. ORERA is an authority established under the Real Estate (Regulation and Development) Act, 2016, which aims to promote transparency and accountability in the real estate sector.
However, this notification will only be effective if the Odisha Real Estate Regulatory Authority continues to be an authority under the Real Estate (Regulation and Development) Act, 2016 with one or more of the purposes specified in sub-clause (a) of clause (46A) of section 10 of the Income Tax Act.
The Real Estate (Regulation and Development) Act, 2016, is a landmark legislation designed to protect the interests of homebuyers and to ensure timely completion of real estate projects. It mandates the establishment of Real Estate Regulatory Authorities (RERAs) in each state to regulate and promote the real estate sector.
The income tax exemption for ORERA is a step towards ensuring that the authority can function effectively and efficiently, without the burden of tax liabilities. This move is expected to bolster the regulatory framework and enhance the transparency and accountability of real estate projects in Odisha.
