Delhi High Court Bars Pune-Based ‘Lenscut’ for Trademark Infringement on Lenskart
New Delhi/Pune, 18th August 2025: The Delhi High Court has passed a significant order in favor of Lenskart Solutions Limited in a trademark infringement case against a Pune-based eyewear retailer, Lenscut. The court found that Lenscut was operating a store with branding, logos, and store design that closely resembled those of Lenskart, potentially misleading customers into believing there was a connection between the two brands.
The order was passed by Justice Tejas Karia after Lenskart brought the matter to the court upon discovering that Lenscut had opened an outlet in Pimple Saudagar, Pune, right next to an existing Lenskart store. The signage, staff uniforms, bills, invoices, and shop interiors at Lenscut reportedly bore a striking resemblance to Lenskart’s registered trademarks.
Evidence of Deceptive Similarity
Lenskart presented photographs and invoice copies before the court, demonstrating how customers were being misled into associating Lenscut with Lenskart. The court noted that the deliberate imitation of branding amounted to passing off and infringement of Lenskart’s well-established trademark rights. This mimicry included not only the name and logo but also the overall aesthetic and design of the store, which could easily confuse consumers.
Court’s Directions
Recognizing the urgency of the matter, the Delhi High Court issued the following directions: - Ex-parte Injunction : Lenscut has been restrained from using the mark “Lenscut” or any other deceptively similar name or logo to Lenskart. - Court Raids in Pune : A Local Commissioner has been appointed to conduct raids at Lenscut’s premises on August 14, 2025, with assistance from the Police. - Seizure of Goods : Infringing products, marketing material, and accounts are to be seized, listed, and valued. The seized goods will remain under court supervision.
Lenskart’s Brand Protection
The court observed that Lenskart, established in 2008, is the first and rightful user of the brand and has invested substantially in building its reputation in India and abroad. By copying Lenskart’s name and distinctive brand identity, Lenscut was attempting to ride on its goodwill and unlawfully profit from its reputation, the court said. Lenskart has been proactive in protecting its brand, which has become a household name in the eyewear industry.
The matter has been listed for further hearing on November 24, 2025.
