Maharashtra Bans Registration of Flats Without Approvals or Excess Area

By GeoSquare News Desk · Published 2026-10-15

The Maharashtra government has barred the registration of flats that lack necessary approvals or exceed the sanctioned area. The move, enforced under the Real Estate (Regulation and Development) Act, 2016, is aimed at tightening the noose around developers who flout building norms and compromise buyer interests.

What the New Rule Means

All projects, whether registered under Section 3 of the RERA Act or those exempt from such registration, now face a blanket restriction. No flat can be registered if the project does not hold valid approvals from the competent authorities, or if the constructed area deviates from the sanctioned plan.

This effectively makes it mandatory for developers to ensure that every unit is built strictly as per approved plans and that all statutory clearances are in place before selling or registering any property.

Impact on Homebuyers

For buyers, this is a significant protective measure. Before purchasing a flat, they must now verify that the project has all required approvals and that the carpet area matches the sanctioned layout. Any mismatch could render the property ineligible for registration, leading to legal complications later.

Real estate experts believe this will curb illegal constructions and force developers to adhere to building bylaws. It is also expected to reduce disputes over property titles and possession, making the Maharashtra market more transparent and reliable for investors.
