Odisha Government Mandates CC and OC for Real Estate Handovers

The Odisha Housing and Urban Development (H&UD) department has issued a notification, following a Supreme Court directive, mandating that realtors obtain a building’s Completion Certificate (CC) or Occupancy Certificate (OC) before handing possession over to buyers. This move aims to ensure that all constructions adhere to approved plans and meet safety and regulatory standards.

As per the Odisha government's notification, developers must submit a formal undertaking to that effect when applying for building permits. Throughout the construction process, they are required to display the approved plan, which will be subject to periodic inspections by development authorities. This ensures transparency and accountability in the construction process.

Construction must strictly adhere to the approved design. Any discrepancies will lead to the deferral of OC issuance and may result in legal consequences. Essential services such as electricity, water, and sewerage will only be activated after the CC or OC is granted. This measure is designed to protect the interests of homebuyers and ensure that the buildings they purchase are safe and compliant with regulations.

Unauthorized buildings will neither receive trade/business licenses nor be eligible for bank loans. This strict enforcement is expected to curb unauthorized constructions and ensure that all buildings meet the necessary standards.

- While issuing the building planning permission, an undertaking must be obtained from the builder or applicant to the effect that possession of the building will be entrusted and/or handed over to the owners or beneficiaries only after obtaining the completion or occupation certificate from the authorities concerned. - The builder, developer, or owner must display a copy of the approved plan at the construction site during the entire period of construction. The authorities concerned will inspect the premises periodically and maintain a record of such inspections in their official records. - Upon conducting a personal inspection and being satisfied that the building is constructed in accordance with the building planning permission given and there is no deviation in such construction in any manner, the completion or occupation certificate in respect of residential or commercial building will be issued by the authority concerned to the parties concerned, without causing undue delay.

If any deviation is noticed, action must be taken in accordance with the Act, and the process of issuance of the completion or occupation certificate should be deferred until the deviations pointed out are completely rectified.
