Pune: MahaRERA Directs Developers to Rectify Leakage and Construction Defects in Homebuyer's Flat
Pune, 22nd November 2025: The Maharashtra Real Estate Regulatory Authority (MahaRERA) has issued a directive to developers V.R. Kulkarni and Associates and S.R. Kulkarni Developers to address leakage and other construction defects in a flat within 30 days. The order follows a complaint filed by Amit Shah, a member and former chairman of Meghdoot Tower Co-operative Housing Society.
In its ruling, MahaRERA noted that the photographs submitted by Shah clearly demonstrated the presence of leakage inside the flat, thereby establishing a deficiency in the construction quality. The regulatory body instructed the developers to undertake the necessary repairs to ensure that these defects do not reoccur in the future.
Shah had also sought additional reliefs, including the resolution of lift defects, the installation of back-feeder cables to transformers, the provision of lift cameras, and the construction of amenities such as a gym, clubhouse, and swimming pool. He further requested compensation for the alleged failure to fulfill obligations under the RERA Act and the sale agreement.
However, MahaRERA observed that these issues fall outside the scope of an individual complaint and cannot be adjudicated in the present proceeding. The Authority emphasized that while it is committed to addressing construction defects and ensuring compliance with the RERA Act, broader issues related to amenities and additional facilities must be addressed through separate legal channels.
Shah stated that he had made multiple written and oral requests to both developers but received no response, leading him to file the complaint with MahaRERA. “The complaint has been partially allowed by the Authority. I will explore further legal options to ensure that all my concerns are adequately addressed,” he added.
This case highlights the ongoing challenges faced by homebuyers in ensuring that developers adhere to the quality standards and obligations outlined in the RERA Act. It also underscores the importance of MahaRERA in providing a platform for homebuyers to seek redressal for construction defects and other related issues.
