A habeas corpus petition is a legal action that can be taken to bring a person who is being detained to court to determine if the detention is lawful. It is often used in cases where individuals are held against their will.
The woman sent an alarming message to her friends via WhatsApp because she was being assaulted and threatened by her parents to marry against her will. Her phone was also confiscated, making it difficult for her to communicate freely.
The Ambegaon police, following the direction of the Bombay High Court, traced and brought the woman back from Samastipur, Bihar, where her family was holding her against her will. The police faced resistance from her family but successfully rescued her.
The woman told the Bombay High Court that she wishes to live and work in Pune of her own free will, without any interference from her parents. She stated that she is not under any threat or pressure from anyone and is not in contact with her parents.
The court noted that the woman is residing in Pune at her free will and is not under any threat. Following her statement, the petition was withdrawn. The court also stated that the woman is free to approach the court if there is any further cause of action.
