50,000+ Real Estate Cases Pending in Consumer Courts: A Growing Concern
Real Estate:Over 50,000 cases related to real estate are pending in consumer courts, as per the latest government data. This alarming figure has raised concerns about the efficiency of the consumer dispute redressal system in India.

In a written reply to the Lok Sabha, Minister of State for Food and Consumer Affairs B L Verma shared the details of cases pending in consumer commissions related to real estate. According to the data, a total of 2,44,813 cases were filed in consumer courts at the national, state, and district levels.

Out of these, 1,94,555 cases have been disposed of, leaving 50,258 cases pending as of July 31, 2024. This staggering number highlights the need for a more efficient and speedy redressal mechanism for consumer disputes.

The Consumer Protection Act, 2019 provides for a three-tier quasi-judicial machinery at the district, state, and central levels, commonly known as 'Consumer Commissions' for protection of the rights of consumers and to provide simple and speedy redressal of consumer disputes.

The Act also provides for simplification of the adjudication process in the consumer commissions, filing of a complaint by a consumer in the consumer commission, virtual hearing, and deemed admissibility of complaints if admissibility is not decided within 21 days of filing.

Section 38(7) of the Consumer Protection Act, 2019 prescribes that every complaint shall be disposed of as expeditiously as possible, and endeavour shall be made to decide the complaint within a period of three months from the date of receipt of notice by opposite party where the complaint does not require analysis or testing of commodities and within five months if it requires analysis or testing of commodities.

To facilitate online consumer complaints, the e-Daakhil portal has been launched in 35 states/UTs, allowing aggrieved consumers to register complaints in different consumer commissions from anywhere in India.The growing number of pending cases in consumer courts is a cause for concern, and the government needs to take steps to address this issue and ensure that consumers receive speedy and effective justice.

The real estate sector is a significant contributor to India's economy, and any disputes or issues related to it can have far-reaching consequences. It is essential to have a robust and efficient dispute redressal mechanism in place to protect the rights of consumers and promote a healthy and transparent real estate market.The Ministry of Consumer Affairs, Food and Public Distribution is responsible for ensuring the interests of consumers are protected and promoting a fair and competitive market in India.
