Bombay HC Refuses Writ Plea in Malad Redevelopment Row

By GeoSquare News Desk · Published 2026-10-28

The Bombay High Court has declined to entertain a writ petition filed by flat buyers in a Malad redevelopment project, which raised grievances over flat area, amenities and compensation. The court observed that such issues are essentially contractual in nature and do not fall within the purview of writ jurisdiction.

What the dispute is about

The petitioners had alleged that the redevelopment agreement was not honoured in terms of the promised carpet area, amenities and compensation package. The High Court, however, noted that these are factual matters requiring adjudication on evidence and cannot be resolved through a writ petition.

Where should buyers go?

Directing the petitioners to approach the appropriate forum, the court indicated that civil courts or the Maharashtra Real Estate Regulatory Authority (MahaRERA) are the proper avenues for such complaints. This reinforces the role of RERA as the designated regulator for real-estate disputes, including redevelopment projects.

What this means for property buyers

The ruling serves as a reminder for flat buyers to maintain clear documentation and follow the contractual dispute-resolution mechanism. For redevelopment-related issues such as deviation in area, missing amenities or inadequate compensation, approaching MahaRERA or a civil court is the legally sound path.
