Bombay HC sets aside MahaREAT order in Turf View project case

The Bombay High Court has set aside an order passed by the Maharashtra Real Estate Appellate Tribunal (MahaREAT) in a dispute linked to the Turf View project, effectively clearing a key procedural hurdle for the proposed residential development.
What the tribunal order had done
MahaREAT had earlier restored the residential status of the land concerned, a decision the developer moved the High Court against. The appellate tribunal had ruled in favour of restoring the residential classification, which would have allowed the project to proceed on that footing.
High Court intervention
Holding that the tribunal's reasoning could not be sustained, the High Court set aside the MahaREAT order, returning the matter for fresh consideration. The ruling means the questions around the land's permissible use and the project's sanctioning route will have to be revisited at the appropriate stage.
Why it matters for Mumbai buyers
For Maharashtra homebuyers and investors, such tribunal-versus-court disputes are a reminder that sanctioning status, land-use permissions and approved plans are as important as location and price. Buyers of under-construction flats should verify the sanctioned plan and land-use approvals held by a project rather than relying on marketing material.
Project status
The High Court's decision does not by itself approve or halt construction; it only removes the earlier tribunal order from the record. Work, possession timelines and any approvals will now depend on how the matter progresses further before the relevant authorities and courts.
Buyers weighing options in the Mumbai Metropolitan Region should review RERA-registered project disclosures, sanctioned plans and the developer's track record before committing to a booking.
