Bombay High Court Revokes Pune Court's Interim Order in Lohgaon Property Dispute
Mumbai/Pune, 14th March 2026: The Bombay High Court has set aside an interim order issued by the Pune District Court in a property dispute between Runwal Enterprises and Bridge Water Realty LLP, providing significant relief to Runwal Enterprises in the ongoing matter.
The dispute revolves around a property located in Mouje Lohgaon, Haveli taluka, Pune district. Initially, the Pune District Court had granted interim relief in a Civil Miscellaneous Application filed by Ranjeet Darak of Bridge Water Realty LLP. The order restrained Runwal Enterprises from transacting, transferring, assigning, or creating any third-party interest in the disputed property.
Challenging this order, senior counsel representing Runwal Enterprises argued before the Bombay High Court that the company had not been served notice regarding the filing of the Civil Miscellaneous Application before the Pune District Court. They contended that the district court had passed an ex-parte order without giving Runwal Enterprises a fair opportunity to present its case.
The court was also informed that the Pune District Court had not provided any reasons for issuing the ex-parte order. The counsel further argued that there was no urgency in the application that warranted such interim relief and that Bridge Water Realty LLP was not in possession of the disputed property. Therefore, the blanket temporary injunction was deemed unjustified.
After hearing arguments from both sides, the Bombay High Court set aside the interim order issued by the Pune District Court and directed both parties to maintain the status quo regarding the property until further proceedings.
Meanwhile, a First Information Report (FIR) has been registered against Ranjeet Darak and Nitin Chavan, partners of Bridge Water Realty LLP, along with Meenadevi Satish Mittal, Ashish Satish Mittal, Kavita Ankush Agarwal, and Nitin Satish Mittal, who are heirs of the late Satish Mittal. The FIR was registered by the Economic Offences Wing through Chembur Police Station.
The case has been registered under provisions of the Bharatiya Nyaya Sanhita, including Section 318(4) (cheating), Section 61(2) (criminal conspiracy), and Section 3(5) (common intention to commit a criminal act), which carry a punishment of up to seven years’ imprisonment. The investigation is currently underway.
Runwal Enterprises has also written to the Enforcement Directorate (ED), alleging fraudulent acts by Ranjeet Darak, Nitin Chavan, and others. The company has requested a full and impartial investigation into the matter and has sought appropriate action as per the law.
