Builder Firm Faces Legal Action After 32-Year Delay in Thane Housing Project

A property dispute dating back more than three decades has resurfaced, leading to the registration of a cheating case against a builder firm at Mulund police station. The case concerns a payment of Rs 2.89 lakh made in 1993 for a flat in a proposed housing project on Ghodbunder Road, Thane, which was never completed.

According to the police, the flat was booked in January 1993 through a bank transaction for a flat on the 12th floor of the planned complex. Despite repeated assurances, the project was never delivered, nor was the amount refunded. Over the years, the buyers and their heirs pursued the matter through reminders and legal notices, including communications in 2012, 2013, and 2024. However, no response was received from the firm behind the project.

Following the death of the original purchaser in 2015, the legal heirs continued the pursuit but failed to secure either possession or a refund. In December 2024, important case-related documents were reportedly misplaced en route to court, prompting a separate police complaint. Subsequently, a private complaint was filed before a local court, which directed police to investigate.

Acting on this direction, Mulund Police have now registered a case under the Bharatiya Nyaya Sanhita (BNSS), 2023, for cheating and conspiracy against the firm and its directors, Sanjay Jain and Sanjay Shah. An investigation has been initiated, and the accused parties will be questioned in connection with the decades-old transaction, police said.
