The Calcutta High Court has ordered the demolition of a 26-floor residential tower at Elita Garden Vista, finding it was constructed illegally at the cost of the undivided share of flat owners in other 15 towers of the same real estate project.

The 16th tower was ordered to be demolished because it was illegally constructed without the consent of the existing flat owners of the 15 towers and through fraudulent means, as determined by the Calcutta High Court.
The original sanction plan for Elita Garden Vista, approved in 2007, permitted the construction of 15 towers, each with about 23 stories and containing 1,278 flats in total.
The Court ordered an inquiry into the actions of the engineers and officers of the New Town Kolkata Development Authority (NKDA) who were involved in granting the revised sanction plan for the 16th tower, and they may face departmental and criminal proceedings.
The Court ordered that the purchasers of the apartments in the 16th tower and the commercial plaza be refunded the price of each apartment paid by them to the promoter, with interest at the rate of 7 percent per annum.
The Court cited the rights of the flat owners under Article 300A and emphasized that the purchase of flats not only creates rights in the flats themselves but also in the proportionate share of the land.
