The main issue is that a developer and his partners sold flats that were already mortgaged to a credit cooperative society, defrauding home buyers of Rs 1.84 crore.
One of the flat owners, who discovered the fraud, registered the complaint with the Dehu Road police.
The developer obtained a loan of Rs 2 crore by mortgaging 14 flats in the housing complex and then sold eight of these flats to home buyers.
MahaRERA, the Maharashtra Real Estate Regulatory Authority, requires developers to disclose any loans on properties. The developer in this case failed to do so and uploaded false information.
The Dehu Road police have registered a case under sections 406 (criminal breach of trust) and 420 (cheating) of the Indian Penal Code against the developer and seven others.
