The core issue is that flat buyers were allegedly cheated by real estate firms Rudra Buildwell Realty Pvt. Ltd, H R Infracity Pvt Ltd, U M Architectures and Contractors Ltd. The firms promoted a housing project called 'Serra Bella' (later renamed 'Pavo Real') but failed to develop the land as promised, and the project was not approved by the authorities.
Gautam Gambhir was a director and brand ambassador of the joint venture between the real estate firms. He held the position of additional director from June 29, 2011, to October 1, 2013, and had financial transactions with Rudra Buildwell Realty Pvt. Ltd.
The court ordered a fresh investigation because the previous magisterial court order reflected an 'inadequate expression of mind' in deciding the allegations against Gautam Gambhir. The court felt that the allegations and financial transactions involving Gambhir required further scrutiny.
The complainants paid amounts ranging between Rs 6 lakh and Rs 16 lakh for the flats but received no significant infrastructural development. The land remained undeveloped, and the project was not approved by the competent authorities.
A stay order was passed by the Allahabad High Court in 2003, prohibiting any development on the land. This stay order was in place due to litigation over the possession of the land.
