The RERA Act, or the Real Estate (Regulation and Development) Act, is a law enacted in 2016 to regulate the real estate sector, protect homebuyers, and ensure transparency and accountability in real estate transactions.
The homebuyers filed a complaint because the builder, Ozone Infra Developers, failed to deliver the apartment as per the agreed timeline and did not communicate the status of the project or refund the amount paid.
The Authority directed Ozone Infra Developers to refund Rs. 70.33 Lakhs to the homebuyers, including interest, for the delayed possession of the apartment.
The Authority referred to the Supreme Court decisions in M/s Newtech Promoters and Developers Pvt. Ltd vs. State of Uttar Pradesh & Ors and M/s Imperia Structures Limited v. Anil Patni & Anr, which support the homebuyer's right to seek interest for delay and the builder's obligation to return funds if possession is not delivered on time.
The agreement of sale is a binding legal document that must be clear and enforceable. In this case, the builder's failure to comply with the terms of the agreement amounted to a breach of contract.
