Maharashtra Bars Society Members and Relatives as Developers

By GeoSquare News Desk · Published 2026-10-27

The Maharashtra government has barred managing committee members, office-bearers of housing societies, and their relatives from acting as developers in redevelopment projects. The move aims to prevent conflicts of interest and ensure transparency in the redevelopment process across Mumbai and other cities in the state.

Why the restriction?

Redevelopment of old and dilapidated societies often involves a developer selected by the society's managing committee. In several instances, committee members or their kin were found to be directly or indirectly involved as developers, leading to questions about fair selection and pricing. The new restriction seeks to eliminate such practices and protect the interests of flat owners.

What does it mean for societies?

Societies planning redevelopment will now need to ensure that no committee member, office-bearer, or their relative has any stake in the developer entity. This includes direct or indirect involvement in the developer firm. The rule is expected to push societies towards more transparent bidding and selection of developers, with decisions made purely on merit and financial viability.

Impact on Mumbai redevelopment market

Industry experts believe this will bring greater trust among homebuyers and existing residents. With clear segregation between society management and developer roles, redevelopment projects may see smoother approvals and fewer disputes. However, societies must carefully review their agreements and ensure compliance before signing any redevelopment contract.
