The main issue was the delayed possession of flats and the failure to deliver occupancy certificates as promised in the agreement.
The complainants accused the developers of misrepresentation, arbitrary revision of timelines, and unsafe construction practices.
The developers argued that the delays were due to force majeure factors such as COVID-19 disruptions, environmental clearance issues, and litigation, and that possession was contractually extended to June 2020.
The Commission directed the developers to hand over possession of the flats with an occupancy certificate and promised amenities, pay 8% annual interest on the amount paid, and compensate the complainants with Rs 1 lakh and Rs 25,000 towards litigation costs.
This decision sends a strong message to real estate developers about the importance of adhering to their contractual obligations and maintaining transparency with their clients.
