Maharashtra IGR Assures Banks on Legality of E-Registered Property Documents

Maharashtra IGR Assures Banks on Legality of E-Registered Property Documents
Real Estate Pune:Pune: Property documents registered through developers' offices using Maharashtra's e-registration system are legally valid, secure, and verifiable, and should be readily accepted by banks for loan processing, Inspector General of Registration and Controller of Stamps Ravindra Binwade said on Wednesday.

He was addressing representatives from various banks and financial institutions at a meeting organised by the Registration and Stamps Department in Pune to review the implementation of the e-registration and e-SBTR (Electronic Secure Bank and Treasury Receipt) systems.

Since the launch of the e-registration facility in 2020-21, more than 31,785 documents were registered digitally across the state. The initiative, aimed at simplifying property transactions, allows citizens to complete first-sale agreements online without visiting sub-registrar offices. Instead, the entire process — including capturing photographs, thumb impressions, and Aadhaar verification — can be done at the developer's office.

Binwade clarified that documents registered through this system are fully compliant with the Registration Act, 1908, and the Maharashtra E-Registration Rules, 2013. 'Documents printed on e-SBTR, digitally signed and registered through the e-registration platform, are considered original under the law,' he said. 'Banks should have no hesitation in accepting them.'

Several citizen groups had reached out to the registration department to communicate to the banks as many were denied loans for these registrations. 'Many clients had to go again to the main registration office and get the document stamped from them,' S Joshi said. Developers too said that it was necessary for the registration department to clarify as only then more developers will come forward. As many as 700 developers are carrying out registrations of first sale of flats from their own offices in the state.

Officials added that to ensure the authenticity of these documents, the department has put in place multiple verification mechanisms. Each e-registered document carries a QR code on every page that can be scanned for validation. In addition, the e-SBTR, issued by authorised banks after payment of stamp duty, comes with a unique GRN (Government Reference Number) and stationery number, both of which are reflected in the registration summary.

Every document is also digitally signed by the sub-registrar, making it tamper-proof. Banks and NBFCs can further verify the legitimacy of such documents using the e-Search portal available on the IGR Maharashtra website.

Binwade assured participants that the e-SBTR system, in place since 2013, has maintained a clean record with no instances of duplication or malpractice. The department has now made it mandatory for the first page of an e-registered document to be printed on the original e-SBTR or stamp paper, ensuring that only one legally valid copy exists.
