A separate RERA-like law is needed because redevelopment activities are currently outside the scope of the RERA Act, 2016, leaving complaints from homeowners unaddressed by MahaRERA. This law aims to ensure better regulatory oversight and protection for homeowners involved in redevelopment projects.
Homeowners in redevelopment projects often face financial and residential distress due to delays in project completion. They may be compelled to live in transit accommodations or rely on monthly rent payments from developers, which can be delayed or discontinued.
The policy proposes a cluster redevelopment model for greater efficiency and scale, allowing multiple adjoining projects to be developed simultaneously. This approach aims to optimize land use and expedite project completion.
The new law strongly supports self-redevelopment initiatives by cooperative housing societies. The state has allocated ₹2,000 crore and proposed the formation of a dedicated cell to assist societies in planning and executing redevelopment independently.
MahaRERA has historically declined to intervene in redevelopment-related complaints, ruling that such complaints fall outside its jurisdiction. Homeowners are advised to approach other competent authorities for resolution.
