MahaREAT Orders Purva Oak to Refund ₹1.85 Crore to Thane Homebuyer

By GeoSquare News Desk · Published 2026-10-14

The Maharashtra Real Estate Appellate Tribunal (MahaREAT) has ordered developer Purva Oak to refund ₹1.85 crore to a Thane homebuyer over delayed possession of a booked unit. The decision strengthens the legal position of homebuyers seeking relief under the Real Estate (Regulation and Development) Act, 2016.

The Case

The homebuyer had invested in a residential project by Purva Oak in Thane. After the developer failed to deliver possession within the agreed timeline, the buyer approached MahaRERA. However, MahaRERA dismissed the complaint as premature in September 2021, prompting the buyer to file an appeal before MahaREAT.

The Ruling

MahaREAT found the delay unjustified and directed the developer to refund the entire amount paid by the homebuyer, along with applicable interest. The tribunal also ruled that the developer cannot compel a buyer to accept possession of an incomplete or delayed project, as such a practice violates RERA norms.

What It Means for Homebuyers

This order is a significant reminder for Maharashtra homebuyers that RERA and its appellate mechanism are effective tools against errant developers. Buyers facing similar delays should maintain all payment records and correspondence, and approach MahaRERA or MahaREAT for timely relief. The ruling also discourages developers from sitting on buyer funds without delivering projects on schedule.
