The new SOP issued by MahaRERA is a Standard Operating Procedure to expedite the recovery of compensation from developers for aggrieved homebuyers within 60 days.
If a developer fails to pay compensation within 60 days, the case will be sent to the Principal Civil Court of the respective area, and the erring builder may face up to 3 months of imprisonment.
Common issues include failure to receive possession of the apartment by the deadline, sub-standard construction quality, lack of parking, and missing amenities.
MahaRERA ensures recovery by sending a Recovery Warrant to the District Collector to initiate the seizure or attachment of assets and bank accounts of the defaulting developer.
The SOP has vague timelines that may extend disposal timelines, and the MahaRERA recovery warrant portal lacks real-time updates and digital links to pending appeals.
