MahaRERA Orders Builder to Pay Interest to Homebuyer Who Paid Rs 39.15 Lakh

By GeoSquare News Desk · Published 2026-10-12

A Pune homebuyer who booked a flat for Rs 41.85 lakh and paid Rs 39.15 lakh towards it, but never received possession, has secured relief from the Maharashtra Real Estate Regulatory Authority (MahaRERA).

Builder's jurisdiction excuse rejected

The builder argued that project delays stemmed from shifting jurisdiction between the Pune Municipal Corporation (PMC) and the Pune Metropolitan Region Development Authority (PMRDA). MahaRERA was not persuaded, holding that such administrative changes cannot relieve a developer of contractual obligations towards allottees.

Interest ordered on the amount paid

The authority directed the developer to pay interest to the homebuyer on the Rs 39.15 lakh already deposited, effectively recognising that delay costs cannot be passed on to the buyer. The order underlines that possession timelines and payment terms remain binding regardless of external regulatory realignments.

What it means for Pune buyers

Pune's peripheral belts have repeatedly seen projects caught between PMC and PMRDA boundaries, causing approval and completion delays. The ruling sets a clear precedent: buyers who have paid up substantially cannot be left waiting indefinitely, and delay compensation is enforceable under MahaRERA.

Experts advise allottees to track registered projects on the MahaRERA portal, retain payment receipts, and file complaints promptly where possession slips beyond the committed date.
