19,000 Mumbai Buildings Lack OC: What Buyers Must Know
By GeoSquare News Desk · Published 2026-10-31
Mumbai's real estate market is staring at a massive compliance gap. Nearly 19,000 buildings across the city are operating without Occupation Certificates (OCs), leaving lakhs of residents and prospective buyers in a legally vulnerable position.
An Occupation Certificate is the municipal authority's final approval confirming that a building has been constructed as per sanctioned plans and is fit for occupation. Without it, a property cannot be legally registered, banks refuse home loans, and residents face the risk of penalties or even demolition.
BMC Amnesty Scheme: A Chance to Regularise
The Brihanmumbai Municipal Corporation (BMC) has rolled out an amnesty scheme that allows building owners to regularise their structures by paying a prescribed fee. The scheme aims to bring non-compliant buildings into the legal fold and clear the city's long-pending OC backlog.
However, experts flag two major hurdles — low awareness and high costs. Many housing societies and individual owners are unaware of the scheme, while others are discouraged by regularisation fees that can run into lakhs, depending on the building's size, age, and location.
What Buyers Should Do
For property buyers, the absence of an OC is a serious red flag. It impacts resale value, blocks financing, and can lead to legal disputes over title. Before purchasing any property in Mumbai or elsewhere in Maharashtra, verify the OC status with the municipal corporation. If the building is covered under the amnesty scheme, confirm whether regularisation has been completed or is in progress. Investing in an unregularised property is a high-risk gamble that can result in financial and legal trouble down the line.
