Mumbai Society Can't Label Doctor A Defaulter: Court

By GeoSquare News Desk · Published 2026-10-08

A Mumbai doctor who owns a ground-floor unit in a residential society has obtained interim protection from a Maharashtra court, after the society moved to declare him a defaulter over unpaid maintenance of Rs 1.42 lakh.

The dispute over maintenance dues

The society's demand went beyond the principal amount, with the flat owner being charged an interest component of about 18% on the outstanding dues. Such penal and interest levies have become a recurring flashpoint between residents and managing committees across Mumbai's housing societies.

Interim relief for the flat owner

Granting interim protection, the court restrained the society from taking steps that would formally tag the flat owner as a defaulter while the wider proceedings remain pending. The order underscores a growing judicial willingness to examine both the quantum and the manner in which dues and interest are calculated before a resident is stigmatised.

What it means for Maharashtra flat buyers

For buyers and owners in the state's housing complexes, the matter highlights the importance of checking maintenance structures, escalation clauses and interest terms before purchase, and of seeking a court-tested interpretation where the billed amount is disputed.

Experts advise societies and residents alike to maintain transparent billing records and to settle disputes through registered association channels, as unresolved dues increasingly attract penalties that can far exceed the original obligation.
