Real Estate News:The Odisha Real Estate Regulatory Authority (ORERA) has taken a significant step towards ensuring a smoother dispute resolution process for homebuyers, promoters, and agents. The authority has issued detailed guidelines to define the roles and responsibilities of ORERA and complainants, promoting the amicable and effective settlement of disputes under the Real Estate (Regulation and Development) Act, 2016.

The new guidelines aim to enhance the functioning of the Conciliation and Dispute Resolution (CDR) cell, which plays a crucial role in resolving issues between various stakeholders in the real estate sector. According to the guidelines, disputes falling under the purview of the Act can be decided by the CDR cell when referred by ORERA or on an application submitted by one of the parties.

The guidelines specify that during the hearing of complaints by the authority, if there is a possibility of settlement through conciliation, the authority can refer the complaint to the CDR cell with the consent of both parties involved. This process is designed to be transparent and fair, ensuring that all parties have a chance to express their concerns and reach a mutually beneficial agreement.

The party interested in conciliation must file an application, which should be sent to the opposite party via post or email. The opposite party has seven days to convey their consent for conciliation. Upon receiving the consent, the first party must make a payment of Rs 500 to the secretary of ORERA. The matter will then be referred to the CDR cell, and both parties will be informed of the date, time, and venue of the hearing.

During the hearing, both parties are required to be present, and the conciliators will facilitate the resolution process. They can seek assistance from voluntary consumer groups if necessary. If a settlement is reached, it will be put in writing and signed by both parties. In cases where the settlement is not complied with, the non-compliance will be noted in any further proceedings by ORERA if the aggrieved party approaches the authority.

If the parties fail to reach a settlement, the matter will be forwarded to ORERA or another appropriate court. Real estate expert Bimalendu Pradhan praised the initiative, stating that the CDR cell will save both time and money for promoters and homebuyers. 'Nobody wants to stretch a matter unnecessarily if it can be resolved through talks. The CDR cell in ORERA gives the opportunity and it should be promoted,' he said.

These guidelines are expected to bring a significant improvement in the real estate sector by providing a structured and efficient mechanism for dispute resolution. The ORERA's initiative is a step towards building trust and fostering a more transparent and accountable real estate market in Odisha.
