Real Estate Maharashtra:BHUBANESWAR: In a significant move to streamline the resolution of home-buying disputes, the Odisha Real Estate Regulatory Authority (ORERA) has constituted a Conciliation and Dispute Resolution (CDR) cell. This initiative aims to provide an alternative, speedy, and cost-effective method for settling disputes outside the formal court system, ensuring a more amicable resolution for both homebuyers and promoters.

ORERA chairman Asit Kumar Mohapatra stated that the formation of the CDR cell and the drafting of its guidelines are in line with the provisions of the Real Estate (Regulation and Development) Act, 2016. This act mandates the facilitation of amicable conciliation of disputes between promoters and allottees through appropriate dispute settlement forums.

The CDR cell will serve as an alternative dispute resolution (ADR) platform, representing both home buyers and real estate developers. ORERA plans to appoint legal experts to the cell soon, ensuring that the process is fair and well-informed.

Mohapatra emphasized that the primary goal of the CDR cell is to promote a collaborative approach, allowing both parties to engage in a neutral forum and find a mutually acceptable solution. “This approach will not only expedite the resolution process but also reduce the financial burden on both parties,” he noted.

However, Mohapatra acknowledged that previous attempts to establish a functional CDR cell in the state had not been as successful as hoped. To improve the effectiveness of the cell, ORERA is closely monitoring the operations of similar cells in other states, particularly in Maharashtra, where significant progress has been made in facilitating out-of-court settlements.

According to the guidelines issued by ORERA, the CDR cell will address disputes between promoters, agents, and allottees that fall under the purview of the RERA Act 2016. ORERA can also refer matters to the CDR cell for conciliation with the consent of the involved parties.

The CDR cell has a two-month period to resolve disputes. If a mutual agreement is reached, it will be binding on all parties involved. In cases where an amicable settlement is not possible, the conciliation process will be terminated, and the disputes will be pursued as per the legal provisions before ORERA or any other court or forum.

By introducing the CDR cell, ORERA aims to enhance the transparency and accountability of the real estate sector in Odisha, ensuring that homebuyers and developers have a reliable and efficient mechanism for resolving disputes. This initiative is expected to foster greater trust and confidence in the real estate market, ultimately benefiting all stakeholders.
