The accused are charged under sections 406 (criminal breach of trust) and 420 (cheating) of the Indian Penal Code.
MahaRERA, or the Maharashtra Real Estate Regulatory Authority, is responsible for regulating the real estate sector in Maharashtra. The developer was required to mention the loan on the property while registering it with MahaRERA, which he failed to do.
The home buyers discovered the fraud when other residents informed the complainant that the developer had obtained a loan from a credit cooperative society by mortgaging the flats and had not repaid the loan.
Home buyers are advised to verify all documents and seek legal advice before making any significant investments in property to avoid falling victim to similar frauds.
