RERA Orders NBCC to Cease Coercive Actions Against Rajeshwari Realty

The Delhi Real Estate Regulatory Authority (RERA) has issued a directive to NBCC Ltd., a public sector undertaking, to refrain from taking any coercive actions against Rajeshwari Realty Pvt. Ltd. This includes any measures related to electricity or maintenance dues during the pendency of an appeal before the Real Estate Appellate Tribunal (REAT).

The order was issued by a bench consisting of Chairperson Anand Kumar and Member Devesh Singh. Counsel for both parties informed the Authority that NBCC had filed an appeal with REAT but no stay has been granted to date. The appeal is scheduled for hearing on March 9, 2026.

Counsel for Rajeshwari Realty stated that NBCC issued a demand letter dated January 30, 2026, seeking payment of electricity dues. The applicant requested that NBCC be restrained from implementing coercive recovery steps for electricity or maintenance charges while the appeal is pending.

After considering the submissions and the ongoing appeal, the Authority directed NBCC not to initiate any coercive action against Rajeshwari Realty until the next hearing. The case is listed for further proceedings before Delhi RERA on March 18, 2026.

The dispute forms part of a larger disagreement between NBCC and Rajeshwari Realty concerning a commercial project in Saket. Previous proceedings involved challenges related to the project’s regulatory status and compliance under the Real Estate (Regulation and Development) Act, 2016, following which NBCC approached the appellate tribunal contesting the regulator’s directions.

Rajeshwari Realty, a significant allottee in the project, approached RERA seeking interim protection after NBCC issued new payment demands. The Authority’s latest directive prevents any recovery measures against the allottee while the appeal process is ongoing. This decision aims to ensure a fair and transparent resolution of the dispute, maintaining the rights and interests of both parties involved.
