The main issue is that the developer is alleged to have forcibly occupied and altered common areas in the apartment complex, which legally belong to the residents' association.
Residents have filed a formal complaint with the deputy commissioner of police-cum-executive magistrate and organized a silent protest demanding the immediate handover of the common areas.
The Act mandates that all common areas in an apartment complex must be transferred to the association of allottees and developers are restricted from claiming ownership of these areas once individual apartments are sold.
The executive magistrate has issued an interim order preventing both parties from making changes to the common area and instructed the local police to ensure the site remains undisturbed.
A hearing has been scheduled for June 10, and the builder has been asked to explain his actions in court.
