Saudi Arabia has approved a digital identity system for non-resident foreigners to own real estate, paving the way for the implementation of the Non-Saudi Real Estate Ownership Law in 2026.

The Non-Saudi Real Estate Ownership Law is a new legislation in Saudi Arabia that allows non-Saudi foreigners to own real estate in designated areas of the Kingdom. It was approved by the Council of Ministers in July 2025 and will take effect on 21 January 2026.
Non-resident foreigners can obtain a digital ID through the Absher platform, a secure digital service operated by the Ministry of Interior. They must also open a Saudi bank account and secure a local contact number.
Non-Saudis may only acquire property in Makkah and Madinah if they are Muslim. This restriction is due to the religious significance of these cities.
Penalties for legal violations include fines of up to SAR 10 million and the forced sale of the involved property.
The General Real Estate Authority, along with a newly restructured board, will monitor and enforce the provisions of the Non-Saudi Real Estate Ownership Law, including overseeing usufruct rights and ensuring compliance with the law's regulations.
