The Real Estate (Regulation and Development) Act, 2016 (RERA) is a law enacted to regulate the real estate sector in India. It aims to protect the interests of homebuyers, promote transparency, and ensure accountability among developers by mandating adherence to specific regulations and timelines.
The Telangana Real Estate Regulatory Authority (TGRERA) is the regulatory body established under RERA to oversee the real estate sector in Telangana. It ensures that developers comply with the Act and protects the rights of homebuyers by monitoring projects, resolving disputes, and imposing penalties for non-compliance.
The penalty was imposed on the Hyderabad-based realtor for a nine-year delay in project completion, which violated Sections 3 and 4 of the RERA. The realtor failed to meet the agreed-upon timelines and did not provide adequate information to homebuyers about the reasons for the delay.
The penalty of Rs 12.32 lakh will be used to compensate the affected homebuyers and cover any legal or administrative costs associated with the enforcement action. This is aimed at mitigating the financial impact of the delay on the homebuyers.
If homebuyers face delays in their real estate projects, they can file a complaint with TGRERA. The authority will investigate the issue and take appropriate action against the developer, which may include imposing penalties or ordering the completion of the project.
