Ashok Dutta is the proprietor of Sreeram Enterprise and was involved in a development agreement with the landowners for a property in North 24 Parganas.
The development agreement, signed on 17 August 2015, involved the construction of three buildings on a property at 10 Italgacha Road, Dum Dum, North 24 Parganas.
The Appellate Tribunal ruled that the complainants cannot pursue the same cause of action in both the Consumer Commission and the Regulatory Authority simultaneously, setting aside the Regulatory Authority's order and dismissing the complaint.
The landowners can withdraw their case from the Consumer Commission and refile it with the Regulatory Authority if they choose to do so, in accordance with the law.
