Capacit’e Infraprojects Ltd argued that the MahaRERA order was passed under a suo-moto proceeding, which it claimed was not within the powers conferred by the RERA Act, and that the order violated its rights to 10 flats granted by the previous developer.
The Bombay High Court found prima facie substance in Capacit’e’s contentions and granted a stay on the MahaRERA order, questioning the suo-moto aspect of the case and the violation of the principles of natural justice.
