The Anantya slum rehabilitation project is a development initiative in Kurla, Mumbai, aimed at constructing free sale buildings and housing for slum dwellers. It was initially managed by Radius & Deserve Builders LLP.
MahaRERA appointed Chandak Realtors as the new developer due to pending corporate insolvency proceedings against the original developer, Radius & Deserve Builders.
Capacit’e Infraprojects Ltd argued that the MahaRERA order was passed under a suo-moto proceeding, which it claimed was not within the powers conferred by the RERA Act, and that the order violated its rights to 10 flats granted by the previous developer.
The Bombay High Court found prima facie substance in Capacit’e’s contentions and granted a stay on the MahaRERA order, questioning the suo-moto aspect of the case and the violation of the principles of natural justice.
The decision implies that the MahaRERA order may have been passed without proper legal authority and could have violated the rights of third parties like Capacit’e. The case will likely proceed to further hearings to resolve these issues.
