The subvention scheme is a financial arrangement where a tripartite agreement is signed between the builder, home buyers, and financial institutions. The financial institution transfers the loan amount to the builder, who is supposed to pay the EMIs on these loans until the flat is handed over to the buyer.
The CBI filed FIRs against builders because several builders failed to complete construction projects and defaulted on EMIs, leaving home buyers to pay the loans without receiving their homes. This led to significant hardships and financial losses for the buyers.
The CBI raids were conducted in Kolkata, Bengaluru, and Mumbai to investigate the subvention scheme and the fraudulent practices of builders and financial institutions.
The CBI has registered a total of 28 cases, including 22 cases in the National Capital Region (NCR) and 6 cases outside the NCR, against builders and financial institutions involved in the subvention scheme.
The Supreme Court observed the unholy nexus between builders and financial institutions in cheating home buyers through the subvention scheme. The court directed the CBI to register seven Preliminary Enquiries and take further actions to address the fraudulent practices.
