The Bombay High Court ruled that a gift deed by a senior citizen does not need to explicitly state that the transferee will provide for the senior's needs and amenities, as this support is inherently expected.
The senior citizen's complaint was filed under the Maintenance and Welfare of Parents and Senior Citizens Act.
The family allegedly forced the senior citizen to execute a deed of partnership and transfer his flat to them, withdrew Rs 50 lakh from his accounts, and neglected, harassed, and confined him to one room.
The tribunal declared the gift deed void, finding that the family had neglected and not maintained the senior citizen.
The court granted the family three weeks to remove their belongings from the flat.
