Homebuyers' Body Urges RERA Restructuring for Consumer Protection

By GeoSquare News Desk · Published 2026-11-03

The Federation of Property Consumers' Forum (FPCE) has formally written to the Prime Minister, urging a restructuring of the Real Estate (Regulation and Development) Act, 2016 (RERA). The demand centres on separating the twin roles of RERA—protecting homebuyers and promoting the real estate sector—to ensure unbiased enforcement and stronger consumer safeguards.

Why RERA Restructuring?

FPCE argues that RERA's dual mandate creates a conflict of interest, often diluting the authority's focus on consumer grievances. By splitting these functions, the body believes regulatory clarity will improve, leading to faster dispute resolution and stricter compliance from developers. This is particularly relevant for Maharashtra, which has one of the highest numbers of registered projects and pending complaints under RERA.

Impact on Maharashtra Homebuyers

For property buyers in Mumbai, Pune, and other cities, a dedicated consumer protection wing could mean quicker redressal of delayed possession, quality defects, and misleading advertisements. The proposed restructuring would also empower buyers with clearer channels to escalate issues without bureaucratic hurdles. Industry watchers suggest that such a move could restore confidence in the pre-launch and under-construction segments, which are popular among investors.

While the government has not yet responded, the FPCE's initiative highlights a growing demand for a more accountable regulatory framework. Homebuyers in Maharashtra are advised to stay informed about RERA updates and actively participate in public consultations to voice their concerns.
