Maharashtra Stops Registration of Illegal Building Documents

By GeoSquare News Desk · Published 2026-10-15

The Maharashtra government has barred registration of documents for illegal buildings, a move aimed at curbing unauthorised constructions and protecting property buyers. The new circular lays down stricter norms for document registration across the state, including Pune and Mumbai.

Separate rules for RERA-registered projects

As per the circular, projects that are registered with the Maharashtra Real Estate Regulatory Authority (MahaRERA) will need to follow a separate set of document requirements. Unregistered or illegal constructions will not be allowed to register sale deeds or other property documents, effectively making such transactions invalid.

Impact on buyers and investors

Property buyers must now verify the legal status of a project before making any payment. Purchasing an apartment in an illegal building will no longer result in a registered title, leaving buyers with no legal recourse. The move is expected to push demand towards RERA-approved projects and reduce the risk of investing in unapproved layouts.

What developers need to do

Developers will have to ensure their projects comply with all building norms and obtain the necessary approvals from local authorities. Without RERA registration and valid approvals, they will not be able to register documents, which could stall sales and affect project financing. The circular signals a stricter enforcement regime for Maharashtra's real estate sector.
