The case is about a homebuyer who booked three flats in Gokul Silvermist, Santacruz (West) and was expecting possession by December 2017, but the builder has still not delivered possession of the flats.
The Authority has directed the builder to pay interest to the homebuyer from May 2018 until the homebuyer receives actual possession of the flat.
Section 18 of the Real Estate (Regulation and Development) Act, 2016 states that if the builder fails to hand over possession as per the terms of the agreement for sale, the homebuyer has the choice either to withdraw from the project or to stay with it.
