Mumbai Developer Accused of Cheating and Misappropriation of Funds
Real Estate Mumbai:In Mumbai, the RAK Marg police have booked four partners of Sunshine Developers, a real estate company, for allegedly cheating and misappropriating funds from a flat buyer. This is the second FIR registered against Sunshine Developers in less than two months.

The complainant, Chirag Kamdar, a 42-year-old businessman from Matunga, claimed that he had booked a 1,200 square feet flat for Rs 5 crore in an upcoming project in Wadala, constructed by Sunshine Housing Infrastructure Private Limited. Kamdar said he had initially paid a token amount of Rs 25 lakh and later registered the sale deed for the flat, paying a total of Rs 1.10 crore. The building was supposed to be completed, and possession was to be handed over in March 2018.

However, Kamdar discovered that the project work had stopped due to unknown reasons. In December 2018, the developer informed Kamdar that Sunshine Housing had transferred all rights, benefits, and liabilities to SQ Infrastructure. Kamdar signed a no-objection certificate after being assured that the directors, members, and employees were the same in both companies.

Despite the work resuming in 2019, Kamdar received letters from the developer's lawyer, demanding payment of the remaining amount and threatening to cancel the sale agreement. Kamdar later learned that his registered flat had allegedly been transferred to one Ashit Badani.

One of the accused, Kashyap Mehta, has denied the allegations, stating that the FIR is entirely based on false assumptions and that he will use all legal remedies available to counter the fraudulent FIR lodged against him.
