Mumbai Police Book Real Estate Developer for Fraudulent Sale of Flats
Real Estate Mumbai:The Mumbai police have registered an FIR against a real estate developer for allegedly not providing flats to homebuyers at a high-end building in Wadala after receiving ₹100 crore from them. The accused, Subbaraman Anand Vilaynur, along with his wife Uma Subbaraman, B P Gangar Constructions, and other unidentified persons, collected the money from 102 individuals for the “Sky 31” housing project in Wadala (West) since 2018, promising each a flat.

The complainant in the case is a 62-year-old chartered accountant, Anil Dron, who is a resident of Kandivali. Dron alleged that the accused diverted the funds to their personal and other bank accounts instead of using them for the housing project. This diversion of funds has left the homebuyers without their promised flats and in a state of financial distress.

In one particularly egregious instance, the developer allegedly sold the same flat to two different individuals, taking money from both and cheating them. The Economic Offences Wing (EOW) of the Mumbai police registered the FIR after a preliminary inquiry found that a prima facie case of cheating and criminal breach of trust had been made out.

The case is currently being investigated by Banking Unit–3, Cell 11 of the Economic Offences Wing. The FIR has been registered under Sections 420 (cheating), 406 (criminal breach of trust), and 34 (common intention) of the Indian Penal Code (IPC). The investigation is ongoing, and the authorities are working to trace the diverted funds and bring the accused to justice.

This case highlights the ongoing issues in the real estate sector, particularly in high-value projects where developers are accused of misusing funds and failing to deliver on their promises. Homebuyers are often left in a lurch, facing significant financial and emotional losses. The Mumbai police and the EOW are taking a firm stand to protect the rights of homebuyers and ensure that such fraudulent activities are dealt with strictly.
