Nagpur HC Upholds NMRDA Charges: Developers Can't Back Out
By GeoSquare News Desk · Published 2026-10-31

The Nagpur Bench of the Bombay High Court has dismissed a petition filed by Sandeep Developers Pvt. Ltd. and the Agrawal family challenging infrastructure charges levied by the Nagpur Metropolitan Region Development Authority (NMRDA). The court ruled that developers who accept layout approval conditions and sign an agreement cannot later contest the charges.
What the Court Said
Justice held that the petitioners had voluntarily agreed to the terms while seeking approval for their layout. Once an agreement is signed and conditions accepted, it is not open to the developer to turn around and question the validity of infrastructure charges. The petition was dismissed, upholding NMRDA's demand.
Impact on Property Buyers and Investors
This judgment brings clarity to infrastructure charge collection in Nagpur's real estate market. For buyers, it ensures that approved projects carry the required infrastructure obligations, which are meant to fund roads, drainage, water supply, and other civic amenities. For investors, it signals that legal challenges by developers on such grounds are unlikely to succeed, reducing project delays.
What Developers Should Note
Developers must factor in NMRDA infrastructure charges at the planning stage itself. Attempting to avoid these statutory payments after obtaining approval could lead to legal setbacks and project stagnation. The ruling reinforces the authority of urban development bodies in Maharashtra to levy and collect charges as per approved conditions.
