Consumer Court Ruling
The Pune Consumer Commission has ordered Nandgude Patil Developers and its director to refund ₹32.87 lakh to a homebuyer, along with 15% interest, for an inordinate delay in handing over a flat at Sulochana City. The developer had cited the flood-line position as a reason for the delay, but the court dismissed this as a known obstacle that should have been addressed before accepting the buyer's money.
Case Details
The homebuyer had booked a flat in the Sulochana City project, which faced prolonged delays. The court also noted that the agreement was one-sided and heavily favoured the builder. It held that a builder cannot take a buyer's money and later blame obstacles that were known at the time of the agreement.
As per the order, the developer and the director are jointly liable to refund the amount with 15% interest from the date of payment. The ruling reinforces the rights of homebuyers against unfair clauses and unreasonable project delays in Maharashtra's real-estate market.
