ITAT: Property Bought Below Stamp Duty Value Can't Alone Trigger Tax Addition
By GeoSquare News Desk · Published 2026-10-09

A Mumbai property buyer who purchased a Rs 60 lakh flat was handed a Rs 35 lakh addition to taxable income simply because the deal was struck below the circle rate used for stamp duty. The Income Tax Appellate Tribunal (ITAT) has now set aside the addition, giving relief to home buyers across Maharashtra who negotiate discounts on ready-reckoner rates.
What triggered the dispute
Buyers in Mumbai and the MMR routinely purchase property at rates below the official stamp duty valuation, especially in resale deals, distress sales or negotiated transactions. The tax department treated the gap between the declared price and the deemed value as unexplained income and added Rs 35 lakh to the assessee's income, pushing up the tax demand sharply.
What the ITAT said
The tribunal observed that the department cannot make an addition merely on the basis of a difference between transaction value and stamp duty value. It stressed that the taxpayer has the right to get an independent valuation and that the revenue must bring tangible evidence before treating the shortfall as income. Where the purchase consideration is supported by banking channels and the assessee's profile, an addition on purely mechanical grounds is unsustainable.
Why it matters for Maharashtra buyers
Stamp duty in Maharashtra is computed on the higher of transaction value or the ready-reckoner rate, but the ITAT's reasoning makes clear that paying a lower price does not by itself prove concealment. For investors and end-users in Mumbai, Pune, Thane and Nashik, the ruling reinforces that genuine discounted purchases — common in today's softer resale market — should not automatically attract a tax penalty.
Tax professionals advise buyers to keep bank trail, allotment letters, builder-buyer agreement and any correspondence supporting the negotiated price on record. In case of an addition, seeking a valuation by a registered valuer can strengthen the defence.
